Safety & Legal Notice — All NoBrand / ECUWizards Products
1. Scope
This Safety & Legal Notice applies to all products sold under the NoBrand and ECUWizards brands by AFOI THEOCHARI EPE (NoBrand by Theoharis Bros). It forms part of the terms governing your purchase and use of our products. By purchasing or using any product from our store, you acknowledge that you have read, understood, and agree to be bound by this notice.
2. Intended Use & Road Legality
All products are intended for sport, racing, off-road, or closed-circuit use unless explicitly stated otherwise. Products are not guaranteed for road-use or homologation purposes. It is the purchaser's sole responsibility to verify that any product complies with local laws and regulations regarding road use, emissions, noise, and safety requirements in their jurisdiction. Products intended for off-road or competition use may not be legal for street operation in all regions.
3. Compatibility & Vehicle Configuration
Purchasers must verify that any product is compatible with their specific vehicle make, model, year, and configuration before purchase. We provide product information to assist with compatibility assessment, but we do not guarantee fitment for every vehicle variant. Vehicle-specific factors such as engine type, exhaust configuration, frame geometry, and electronic systems may affect compatibility. When in doubt, consult a qualified technician or the vehicle manufacturer before purchasing.
4. Professional Installation
We strongly recommend that all products be installed by qualified professionals. Installation requires proper tools, technical knowledge, and safety precautions. Installation costs are not included unless explicitly stated. Improper installation may result in product failure, vehicle damage, personal injury, or death. The purchaser assumes all risks associated with self-installation.
5. Installation Manuals
Where supplied, installation manuals and manufacturer instructions must be followed carefully. These instructions represent best practices based on general application scenarios. Specific vehicle configurations or conditions may require modifications to the standard installation procedure. When manufacturer instructions conflict with our guidance, follow the more conservative approach to ensure safety and legality.
6. ECU/Calibration & Associated Components
Where applicable, ECU remapping, calibration, or tuning should be performed by qualified professionals following manufacturer specifications. Incorrect ECU calibration can cause engine damage, reduced performance, or unsafe operating conditions. Changes to engine management systems may affect emissions compliance and vehicle warranty status. Associated components such as air filters, exhaust systems, suspension components, and braking systems should be selected and installed as a coordinated system to ensure proper performance and safety.
7. Pre-Installation Inspection
Before installing any product, inspect your vehicle thoroughly and verify compatibility. Check that all mounting points, clearances, and connection interfaces are in good condition. Identify any pre-existing damage or wear that could affect installation or performance. Document the condition of your vehicle before any modifications to establish a baseline for future reference.
8. Post-Installation Safety Checks
After installation, perform a thorough safety check before operating the vehicle. Verify that all fasteners are torqued to specification, all connections are secure, and there are no interference issues with moving parts. Test the vehicle in a safe, controlled environment before regular operation. Monitor performance indicators closely during initial use and address any anomalies immediately.
9. Vehicle Manufacturer Warranty / Warranty Claims
The purchase and installation of aftermarket parts does not automatically void your vehicle manufacturer's warranty. Under applicable law, warranty consequences depend on the specific warranty terms and whether there is a direct causal relationship between the aftermarket part (or its installation) and the claimed defect. If a warranty claim is denied, the burden may be on the dealer or manufacturer to demonstrate that the aftermarket product caused or contributed to the claimed issue. We recommend retaining all installation records, product documentation, and receipts. Consult your vehicle manufacturer or dealer regarding their specific warranty policies before installation.
10. Consumer Statutory Rights & Legal Guarantee
This notice does not affect or waive any mandatory consumer rights granted under applicable EU or national law. Your statutory rights regarding product conformity, fitness for purpose, and legal guarantee remain fully intact. Where local law provides rights beyond those described in this notice, those rights continue to apply. Nothing in this notice is intended to exclude or limit non-excludable statutory protections.
11. Product Safety & Traceability
Products are manufactured and supplied with appropriate identification for traceability purposes. Each product should bear manufacturer identification and product identification markings as required by applicable regulations. Warnings and instructions are provided where applicable. It is the user's responsibility to follow all safety warnings and operational instructions. Keep all product documentation, packaging, and identification labels for the life of the product.
12. Limitation of Liability
To the maximum extent permitted by applicable law, our liability is limited to the purchase price of the product. We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use our products, including but not limited to loss of profits, data, vehicle damage, personal injury, or death. This limitation applies only to the extent it does not conflict with mandatory legal provisions. Where liability cannot be excluded or limited by law (such as death or personal injury caused by negligence), nothing in this notice excludes such liability. Our liability exclusions apply only to cases involving misuse, incorrect installation, failure to follow instructions, unauthorized modifications, or use outside intended parameters.
13. Product Modification Restrictions
Do not drill, cut, heat, weld, or reshape parts unless explicitly instructed to do so by the manufacturer or a qualified professional. Unauthorized modifications to product structure may compromise safety, affect performance, and invalidate applicable guarantees. Products must not be altered in ways that compromise structural integrity or safety features.
14. Shipping, Customs & Taxes
Shipping times and costs are estimated and may vary. Customs duties, import taxes, and other governmental charges may apply depending on the destination country and are the buyer's responsibility unless explicitly stated otherwise. We are not responsible for delays caused by customs processing or government authorities. Buyer should be aware of import restrictions that may apply to their country before purchasing.
15. Returns / Right of Withdrawal
For consumer distance sales within the European Union, you have a 14-day right of withdrawal from the purchase contract under applicable consumer protection legislation. To exercise this right, you must notify us of your decision to withdraw within 14 days of receiving the goods. The goods must be returned in their original condition, unused, and in original packaging. Exceptions to the right of withdrawal may apply for goods made to specification or personalised goods, or where the seal of packaging has been broken for hygiene or safety reasons. Diminished value handling rules apply where goods have been used beyond what is necessary to establish their nature, characteristics, and functioning. Please refer to our applicable Returns Policy for full details on the return process and any exceptions.
16. Counterfeit / Intellectual Property Warning
All products are genuine and sourced from verified manufacturers. We do not sell counterfeit goods. Intellectual property rights of referenced designs, trademarks, and brand names belong to their respective owners. References to vehicle manufacturer names or brand names are for identification and compatibility purposes only and do not imply endorsement or affiliation. Unauthorized reproduction or distribution of our product descriptions, images, or content is prohibited.
17. Installation Cost
Installation costs are the responsibility of the purchaser unless explicitly stated otherwise. We do not provide installation services and cannot guarantee installation outcomes at third-party workshops.
